Terms & Conditions
These Terms govern your access to and use of the Bajrang SuperMarket website and mobile application, and every order you place through them. Please read them carefully.
1. Introduction and parties
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "User", "you", "your") and BAJRANG SUPER MARKET, a partnership firm constituted under the Indian Partnership Act, 1932 and having its principal place of business at Ground Floor, 02, Shilp-3, Sindhu Bhavan Road, Ahmedabad, Gujarat, India 380054 (GSTIN: 24AATFB2737N1ZZ; LEI: 984500ED7EE6FEA0DF10) ("Bajrang SuperMarket", "Company", "we", "us", "our"), which owns and operates the Bajrang SuperMarketgrocery stores in Ahmedabad and the associated website and mobile applications (together, the "Platform").
These Terms apply to all visitors, registered users, and customers of the Platform. By accessing or using the Platform, you agree to these Terms together with our Privacy Policy, Refund & Cancellation Policy, and Shipping & Delivery Policy, each of which is incorporated into these Terms by reference.
2. Acceptance of Terms
This document is an electronic record under the Information Technology Act, 2000 and the rules made thereunder, and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. It is generated by a computer system and does not require any physical or digital signature.
By creating an account, placing an order, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform. We may require you to affirmatively accept these Terms (for example, by clicking "I agree") before completing certain actions.
3. Definitions and interpretation
- "Account" means the account you create to access and use the Platform.
- "Order" means a request placed by you through the Platform to purchase products listed for sale.
- "Products" means the groceries, fresh produce, and household and personal-care goods made available for sale on the Platform.
- "Delivery Staff" means personnel engaged by the Company to deliver Orders.
- "Applicable Law" means all laws, rules, and regulations of India applicable to the Platform and the transactions on it.
Headings are for convenience only and do not affect interpretation. References to the singular include the plural and vice versa. "Including" means "including without limitation".
4. Nature of services
Bajrang SuperMarket is a first-party grocery retailer and, for the purposes of the Consumer Protection (E-Commerce) Rules, 2020, operates as an inventory e-commerce entity — that is, we own the inventory of Products and sell them directly to you. We do not operate a third-party seller marketplace.
We deal in everyday groceries, fresh fruits and vegetables, dairy, packaged foods, and household and personal-care essentials. We do not sell tobacco, alcohol, eggs, meat, fish, or any other non-vegetarian, intoxicating, or age-restricted products. All food Products are sold in compliance with the Food Safety and Standards Act, 2006 and the regulations of the Food Safety and Standards Authority of India (FSSAI Licence No. [FSSAI LICENCE NO.]).
5. Eligibility and user warranties
To register and place Orders, you must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. By using the Platform, you represent and warrant that:
- you are 18 years or older and legally capable of entering into a binding contract;
- the information you provide is true, accurate, current, and complete;
- you will use the Platform only for lawful personal and household purposes;
- you are located within, and require delivery within, our serviceable areas in Ahmedabad, Gujarat.
6. Account registration, security and management
You may be required to register using your mobile number and verify it through a One-Time Password (OTP). You are responsible for maintaining the confidentiality of your Account, OTP, and login credentials, and for all activities that occur under your Account.
- You must notify us immediately of any unauthorised use of your Account.
- You must provide an accurate delivery address, contact number, and any access instructions.
- You may maintain only one Account unless we expressly permit otherwise.
- We may suspend, restrict, or terminate an Account that is used in breach of these Terms, that contains inaccurate information, or that is involved in suspected fraud or misuse.
7. Orders and contract formation
Product listings on the Platform are an invitation to offer and not a binding offer. When you place an Order, you make an offer to purchase the selected Products. A binding contract is formed only when we accept your Order and issue an order confirmation.
We reserve the right to accept or reject any Order, in whole or in part, including where a Product is unavailable or out of stock, where there is an error in the price or description, where the delivery address is outside our serviceable area, or where we suspect fraud or misuse. Where we cancel a confirmed and paid Order, we will refund the amount paid in accordance with our Refund & Cancellation Policy.
8. Pricing, fees, taxes and payment
8.1 Prices and taxes
All prices are displayed in Indian Rupees (₹) and, unless stated otherwise, are inclusive of applicable taxes. Goods and Services Tax (GST) is levied as per Applicable Law. The Maximum Retail Price (MRP) printed on packaged commodities, declared in accordance with the Legal Metrology Act, 2009 and the Legal Metrology (Packaged Commodities) Rules, 2011, will not be exceeded. Prices, discounts, and availability may change at any time without notice; the price applicable to your Order is the price displayed at the time the Order is confirmed.
8.2 Fees and charges
Delivery charges and any handling charges will be displayed at checkout before you confirm your Order. We do not currently require a minimum order value, although this may change in future. We may run promotions, offers, and coupon codes subject to specific terms; we may withdraw or modify them at any time.
8.3 Payment
Payment may be made through the methods displayed at checkout, including UPI, debit/credit cards, net banking, wallets, and, where offered, cash on delivery. Online payments are processed through third-party payment gateways authorised by the Reserve Bank of India (RBI), such as Razorpay, in accordance with their own terms. We do not collect or store your full card number, CVV, UPI PIN, or net-banking credentials. Your use of a payment method is also subject to the terms of the relevant payment provider and your bank.
9. Delivery, risk and failed deliveries
Delivery is governed by our Shipping & Delivery Policy, which forms part of these Terms. We deliver only within our serviceable areas in Ahmedabad. Estimated delivery times are indicative and may vary due to demand, weather, traffic, or operational factors. Title and risk in the Products pass to you upon delivery to you or your nominated recipient at the delivery address.
You must ensure availability to receive the Order during the selected slot and provide accurate address and contact details. We are not responsible for failed or delayed delivery caused by incorrect or incomplete information, unavailability, or lack of access. Handling of failed deliveries and any associated charges or refunds is set out in the Shipping & Delivery Policy and the Refund & Cancellation Policy.
10. Cancellation, refunds and remedies
Cancellations, returns, and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. As we deal in groceries and perishable goods, returns and reverse pick-up are generally not available for reasons of hygiene and food safety; quality concerns must be raised at the time of delivery or within the window stated in that policy. Nothing in these Terms limits your statutory remedies under the Consumer Protection Act, 2019.
11. Product information and food safety
We take reasonable care to describe Products accurately, but product images are for representation only, and the actual Product (including packaging, brand, weight, and batch) may vary. You should read the labels, ingredients, allergen information, and "best before" or expiry details on the Product before use. Perishable and fresh Products are subject to natural variation in size, appearance, and shelf life.
12. User obligations and prohibited conduct
You agree to use the Platform in accordance with Applicable Law and these Terms. In particular, you must not host, display, upload, modify, publish, transmit, or share any information that, as described under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:
- belongs to another person and to which you do not have any right;
- is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy, insulting, or harassing;
- is harmful to a child;
- infringes any patent, trademark, copyright, or other proprietary right;
- violates any law for the time being in force, or is deceptive or misleading;
- impersonates another person or threatens the unity, integrity, defence, security, or sovereignty of India.
You further agree not to:
- use the Platform for any unlawful, fraudulent, or abusive purpose, or place Orders using another person's payment instrument without authorisation;
- introduce viruses or malicious code, or attempt to gain unauthorised access to, interfere with, or disrupt the Platform or its systems;
- use any automated means to access the Platform or collect data from it;
- resell Products purchased on the Platform for commercial purposes without our written consent.
13. Data protection and privacy
We collect and process your personal data in accordance with our Privacy Policy and Applicable Law, including the Information Technology Act, 2000, the rules thereunder, and the Digital Personal Data Protection Act, 2023. By using the Platform, you consent to such collection and processing as described in the Privacy Policy.
14. Intellectual property rights
The Bajrang SuperMarket name, logo, Platform, software, design, text, graphics, and other content are owned by or licensed to the Company and are protected under the Trade Marks Act, 1999, the Copyright Act, 1957, and other Applicable Law. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written permission.
15. Disclaimer of warranties
The Platform is provided on an "as is" and "as available" basis. To the extent permitted by law, and without affecting your statutory rights as a consumer, we do not warrant that the Platform will be uninterrupted, error-free, or secure, or that the information on it is always accurate or complete. Product availability and pricing are subject to change.
16. Limitation of liability
To the maximum extent permitted by Applicable Law, the Company shall not be liable for any indirect, incidental, special, or consequential loss or damage, or for loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform. Subject to your rights under the Consumer Protection Act, 2019, the Company's total aggregate liability in respect of any Order shall not exceed the value of that Order. Nothing in these Terms excludes liability that cannot be excluded under Applicable Law.
17. Indemnity
You agree to indemnify and hold harmless the Company, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any Applicable Law, or your infringement of any third-party right.
18. Electronic communications and marketing
By using the Platform, you consent to receive communications from us electronically, including transactional messages relating to your Account and Orders by SMS, email, WhatsApp, push notification, or call. With your consent, we may also send you promotional and marketing communications; you may opt out of marketing communications at any time through the Platform or by contacting us, without affecting transactional messages.
19. Third-party links and services
The Platform may contain links to, or integrate with, third-party websites and services (such as payment gateways and mapping services). We are not responsible for the content, policies, or practices of such third parties, and your use of them is at your own risk and subject to their terms.
20. Force majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, floods, fire, strikes, civil unrest, war, government action or restrictions, failure of utilities, or network or internet failures.
21. Suspension and termination
We may suspend or terminate your access to the Platform, or cancel Orders, with or without notice, where you breach these Terms or Applicable Law, where we suspect fraud or misuse, or where required by law. You may stop using the Platform and request deletion of your Account at any time as described in our Privacy Policy. Termination does not affect rights and liabilities accrued up to the date of termination.
22. Ratings, reviews and feedback
Where the Platform allows you to submit ratings, reviews, or feedback, you must ensure that your content is genuine, lawful, and not misleading, defamatory, or infringing. You grant us a non-exclusive, royalty-free licence to use, reproduce, and display such content in connection with the Platform. We may moderate or remove content that violates these Terms or Applicable Law.
23. Grievance redressal
In accordance with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and the Information Technology Act, 2000, any complaint regarding the Platform, an Order, or content may be addressed to our Grievance Officer:

We will acknowledge your complaint within forty-eight (48) hours of receipt and endeavour to redress it within one (1) month. Nothing in these Terms prevents you from approaching the appropriate Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
24. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to the dispute-resolution provisions below, the courts at Ahmedabad, Gujarat, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Platform.
25. Dispute resolution
The parties shall first attempt to resolve any dispute amicably through our grievance redressal mechanism. Where a dispute is not resolved within thirty (30) days, it shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by the Company. The seat and venue of arbitration shall be Ahmedabad, Gujarat, India, and the proceedings shall be conducted in the English language. The award shall be final and binding. This clause does not affect your statutory rights as a consumer.
26. General provisions
- Severability: if any provision is held invalid or unenforceable, the remaining provisions shall continue in full force.
- Waiver: our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment: you may not assign your rights under these Terms; we may assign ours to an affiliate or successor.
- Entire agreement: these Terms and the policies incorporated by reference constitute the entire agreement between you and us regarding the Platform.
- Notices: we may give notice to you through the Platform or your registered contact details.
27. Changes to these Terms and acknowledgement
We may update these Terms from time to time. The updated version will be posted on the Platform with a revised "Last updated" date, and your continued use of the Platform after such change constitutes acceptance of the revised Terms.
