Delivery Staff Terms & Onboarding
These Terms apply to delivery personnel engaged by Bajrang SuperMarket and accepted during onboarding through the rider app. They set out eligibility, onboarding, conduct, and compliance requirements.
1. Acceptance and scope
These Terms apply between BAJRANG SUPER MARKET ("Bajrang SuperMarket", "Company", "we", "us"), a partnership firm having its principal place of business at Ground Floor, 02, Shilp-3, Sindhu Bhavan Road, Ahmedabad, Gujarat, India 380054, and the individual engaged as delivery personnel ("you", "Delivery Partner", "Delivery Staff") who delivers Orders from Bajrang SuperMarket stores. You accept these Terms when you complete onboarding in the rider app and each time you use it. These Terms supplement, and do not override, any separate employment or engagement agreement, appointment letter, or Company policy applicable to you; in case of conflict, that agreement and Company policy prevail.
2. Definitions and interpretation
- "Rider App" means the Bajrang SuperMarket application used to receive, navigate, and complete delivery assignments.
- "Order" means a customer order assigned to you for delivery.
- "KYC" means the identity and document verification carried out during onboarding.
- "Customer Data" means personal data of customers that you access to complete a delivery, such as name, address, and contact number.
- "Applicable Law" means all laws, rules, and regulations of India applicable to you and to delivery activities.
3. Eligibility and minimum requirements
To be onboarded and to perform deliveries, you must:
- be at least 18 years of age and legally permitted to work in India;
- be physically fit to carry out delivery duties;
- hold a valid driving licence appropriate to your vehicle under the Motor Vehicles Act, 1988;
- own or have lawful use of a roadworthy vehicle with valid registration certificate, insurance, and Pollution Under Control (PUC) certificate;
- possess a smartphone capable of running the Rider App.
4. Nature of engagement
You are engaged as an employee of the Company. Your employment terms, wages, incentives, and benefits are governed by your employment agreement, appointment letter, and applicable Company policy and labour law. These Terms supplement that agreement by regulating your onboarding and conduct in connection with deliveries; in case of any conflict, your employment agreement and Company policy prevail.
5. Onboarding process and documents (KYC)
For identity verification, statutory compliance, and record-keeping, you agree to provide true, valid, and current copies of the following during onboarding and to update them when they change:
- Aadhaar and PAN (for identity and statutory purposes);
- a valid driving licence;
- vehicle registration certificate, insurance, and PUC certificate;
- a recent photograph and bank account / UPI details for payments;
- any additional document or information reasonably required by the Company.
Providing false, forged, or misleading information or documents is a serious breach and a ground for immediate deactivation, in addition to any action under Applicable Law and your engagement agreement.
6. Background verification and consent
You consent to the Company, or its authorised agencies, carrying out background, document, and antecedent verification, including verification of your identity, address, driving licence, and criminal-record checks where permitted by law. You authorise the Company to retain and process the results of such verification for the purposes of onboarding, safety, and compliance.
7. Your obligations and standards of conduct
- deliver Orders promptly, safely, and to the correct customer and address;
- handle groceries and perishable goods hygienically and maintain the cold chain where required;
- behave courteously, respectfully, and professionally with customers, store staff, and the public;
- follow all applicable traffic and road-safety laws and Company instructions while making deliveries;
- keep your vehicle and any Company-provided equipment (such as delivery bags) clean and in good condition;
- not subcontract, transfer, or allow any other person to use your account or perform deliveries on your behalf.
8. Food safety and hygiene
As deliveries involve food and grocery items, you must maintain personal hygiene, use insulated or clean delivery bags as instructed, keep Orders sealed and protected during transit, and follow the Company's food-safety guidelines, consistent with the requirements of the Food Safety and Standards Authority of India (FSSAI).
9. Cash handling
Where you collect cash-on-delivery payments, you act as a custodian of such cash on behalf of the Company and must deposit or remit it in full and on time in accordance with Company procedures. Any shortfall, delay, or misappropriation may be recovered from you and may lead to deactivation and legal action.
10. Use of the Rider App, account security and acceptable use
- Keep your login credentials secure and confidential; you are responsible for activity under your account.
- Use the Rider App only for authorised delivery activities.
- Do not misuse, modify, reverse-engineer, or attempt to gain unauthorised access to the Rider App or its data.
- Keep location services enabled while on active duty, as required for assignment and navigation.
- Report any technical issue, security incident, or suspected unauthorised access promptly.
11. Health, safety and road safety
You are responsible for driving safely, wearing a helmet, obeying speed limits and traffic signals, and complying with all road-safety rules under the Motor Vehicles Act, 1988. You must not use a mobile phone in a manner that is unsafe or unlawful while driving. The Company encourages you to maintain adequate personal accident and vehicle insurance.
12. Document maintenance and ongoing compliance
You must keep your driving licence, vehicle registration, insurance, and PUC certificate valid at all times while performing deliveries, and provide updated copies to the Company on renewal or on request. The Company may suspend your access where any required document is expired, missing, or invalid.
13. Confidentiality
You must keep confidential all non-public information you receive in connection with deliveries, including Customer Data, Company processes, and commercial information, and must not disclose or use it for any purpose other than performing your duties. This obligation continues after your engagement ends.
14. Data protection
In handling Customer Data, you must comply with the Digital Personal Data Protection Act, 2023 and the Company's instructions. You may use Customer Data only to complete the assigned delivery, must not store, copy, photograph, or share it, and must delete or hand back any such information as instructed. Misuse of Customer Data is a serious breach and may attract legal action.
15. Equality, non-discrimination and dignity
You must treat customers, colleagues, and the public with dignity and respect, and must not engage in any discrimination, harassment, or abusive behaviour on any ground, including sex, religion, caste, disability, or place of origin. The Company is committed to a safe and respectful working environment, including compliance with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 where applicable.
16. Conduct, safety and prohibited acts
- You must not perform deliveries while under the influence of alcohol, drugs, or any substance that impairs your ability to drive safely.
- You must not tamper with, open, consume, or misappropriate any item in a customer's Order.
- You must not behave in a manner that is abusive, threatening, dishonest, discriminatory, or unsafe.
- You must not solicit personal contact with customers or seek tips or payments outside Company-approved channels.
17. Anti-bribery and ethical conduct
You must comply with all anti-bribery and anti-corruption laws, including the Prevention of Corruption Act, 1988, and must not offer, give, solicit, or accept any bribe or improper advantage in connection with your duties. You must act honestly and report any unethical or unlawful conduct you become aware of.
18. Limitation of liability
To the extent permitted by Applicable Law and without affecting your statutory rights, the Company is not liable for any indirect or consequential loss arising from your engagement. Nothing in these Terms limits any liability that cannot be limited under Applicable Law, including in respect of personal injury caused by negligence.
19. Indemnity
You agree to indemnify the Company against losses, claims, damages, and expenses arising from your breach of these Terms, your violation of Applicable Law (including traffic and motor-vehicle laws), your negligence or wilful misconduct, or your misuse of Customer Data.
20. Suspension and deactivation
The Company may suspend or deactivate your access to the Rider App, with or without notice, for breach of these Terms, failure or expiry of verification or documents, unsafe or dishonest conduct, fraud, misappropriation, or persistent customer complaints, in addition to any rights under your engagement agreement.
21. Termination
Your engagement may be terminated in accordance with your engagement agreement and Company policy. On termination or deactivation, you must immediately stop using the Rider App, return any Company-provided equipment and any cash held, and continue to honour your confidentiality and data-protection obligations.

23. Dispute resolution, governing law and changes
These Terms are governed by the laws of India. The parties shall attempt to resolve any dispute amicably; failing which, the dispute shall be subject to the exclusive jurisdiction of the competent courts at Ahmedabad, Gujarat, India, without prejudice to any arbitration or dispute-resolution mechanism in your engagement agreement. We may update these Terms from time to time, and your continued use of the Rider App after such change constitutes acceptance of the revised Terms.
